We have represented public and private national and multinational clients before Romanian courts, Courts of International Commercial Arbitration, and also before bodies with administrative jurisdictional powers: National Council for the Resolution of Disputes (CNSC), the Court of Accounts, the Competition Council, National Audiovisual Council (CNA), Financial Supervisory Authority (ASF) etc., within preliminary and alternative dispute resolution procedures such as especially adjudication within FIDIC Contracts, ad-hoc arbitrations.

Representative mandates in litigation and arbitration

• Representation of one of the largest international providers of precision farming technologies in litigation against the Romanian Ministry of Agriculture aimed to confirm the right of a foreign EU Company to issue agrochemical studies in Romania based on the accreditation certificate obtained in its home country. The case involved combined efforts before national courts - for the recognition of the right to perform services in Romania - and the European Commission, for infringement of EU law;

• Representation of a national company, owner of one of the most iconic buildings in Bucharest, in five litigations involving: (i) claims of over EUR 18,000,000 representing the value of works executed on the property (within lease/association contracts), (ii) cancellation of building permits, (iii) demolition of works executed by a builder of bad faith, (iv) the annulment and termination of contracts etc.;

• Representation of an association that protects the right of constructors in litigation against the Government of Romania for the partial annulment of Government Decision No. 375/2022 which established/regulated the intermediate certification documents;

• Representation of a foreign constructor subsidiary in an arbitration case involving: (i) additional costs and price adjustment reaching approximately EUR 3,500,000 and (ii) extension of contractual warranty duration regarding a public contract for national road rehabilitation following the contract conditions approved by the Government Decision No. 1/2018;

• Representation of an insurance company in a series of litigations involving the right to compensation and litigation against sanction decisions issued by The Financial Supervisory Authority (ASF) during periodic inspections;

• Representation of one of the largest Romanian firearms importers in litigation against ANCEX, (the department of the Ministry of Foreign Affairs that controls the import and export of military goods) aimed to recognise the right of a producer of military goods to import firearms/ammunition for testing, research and development activities;

• Representation of an economic operator (exclusively on competition/cartel and antitrust aspects in public procurement) in a criminal procedure concerning alleged agreements in public tendering procedures;

• Representation of a private economic operator in litigation and actions initiated before the courts and the Competition Council regarding acts of unfair competition manifested through client diversion (both upstream and downstream) and the hiring of key employees aimed at stopping the competitor’s activities and claim for damages of approximately EUR 1,000,000;

• Representation of a Romanian constructor in an arbitration case concerning the execution of a Yellow FIDIC contract for public infrastructure concerning: (i) time extension based on hardship theory, damages exceeding 2 mil Euros, payment for works and enforcement of the Performance Bond Guarantee (GBE); (ii) termination of contract due to beneficiary's fault, payment for works and liquidated damages; (iii) penalties and liquidated damages approximately EUR 10 million for exceeding intermediate deadlines in the execution schedules and for early termination of the contract;

• Representation of one of the largest global management consulting firms in a series of litigations and administrative procedures concerning the cessation of a comparative advertising campaign in the detergent sector, which had an impact on reducing sales by over EUR 4,000,000;

• Representation of a Romanian constructor in arbitration regarding the payment for basic works, additional works, contract termination and damages, with claims reaching over EUR 3,000,000 concerning a contract for the construction of a biomass power plant in Finland;

• Representation of a national body with administrative-jurisdictional activity in litigation concerning the dismissal of its President.
