Offering day by day legal assistance in hydro-technical projects, water and sewage projects, sorting stations, treatment plants, rehabilitation and modernisation of primary district heating networks and coal-fired electricity generation units with works carried out in Romania and abroad (Belgium, Jordan, Egypt, Germany, Estonia etc).
Our specific activities in the legal management of construction projects include:
• drafting and reviewing contracts with suppliers and subcontractors, joint venture agreements, addenda to construction contracts, etc;
• support for the project team in legal issues encountered during execution, contract modifications, taking over;
• review of contractual correspondence;
• assistance in claim procedures, measures to avoid the risk of forfeiture, setting guidelines for the form of claims and identifying cost typologies that need to be prepared and requested in the case of time extension events.
Close cooperation for more than six years with the Romanian Association of Construction Entrepreneurs (ARACO) in the process of improving the construction legal ecosystem and in the representation of the constructors' rights in relation to Romanian authorities.
Numerous Litigation and arbitration mandates:
• Representation of a Romanian constructor in litigation initiated for the termination of a contract for hydroelectric development works, claiming the loss of profit of approximately EUR 15,000,000 and the release of the Performance Bond Guarantee (GBE);
• Representation of a Romanian constructor in three arbitration cases concerning three contracts concluded with the same Employer (Yellow FIDIC and another contract following the conditions approved by Government Decision No. 1/2018) concerning the termination of contracts, price adjustments based on Government Ordinance no. 15/2021 and Emergency Government Ordinance no. 64/2022, reaching over EUR 3,000,000, certification and payment for both basic and 4/7 additional works reaching over EUR 5,000,000 and late payment penalties reaching over EUR 4,000,000;
• Representation of a consortium of contractors in arbitration initiated by the beneficiary of the works regarding an integrated waste management system in Dolj County, for the payment of delay penalties reaching approximately EUR 2,000,000 for exceeding the intermediate reference points in the schedule;
• Representation of a contractor in litigation initiated against the beneficiary for the recovery of the price related to a discount of approximately EUR 8,000,000, for which the contractual conditions have not been fulfilled.
